The Board of Zoning Appeals is a five member board who hears and decides applications for variances from the City of Emporia’s Zoning Ordinance. The Board must find that an unnecessary hardship exists as a result of the literal application of the ordinance because of some peculiarity of the property in question as distinct from the other properties in the same district. The granting of a variance must not be detrimental to the public welfare or injurious to the property in the immediate surrounding area, and must be in keeping with the general purpose, intent and objectives of the City’s Zoning Ordinance. The Board of Zoning Appeals is recommended by City Council and appointed by the Circuit Court.
